Terms of Service
These terms are the agreement between you (the café, food business or person using SafeServe — “you”) and SafeServe, operated by Tiaki Senior, a sole trader based in Nelson, New Zealand (“SafeServe”, “we”, “us”). By creating an account or using SafeServe, you agree to these terms.
1What SafeServe is
SafeServe is a digital tool that helps you keep the records required under your Food Control Plan (FCP) — such as staff training, temperatures, cleaning, suppliers and the other records you choose to use — and to produce them for a verifier.
2Your account
- You must give accurate account and business details, and keep them up to date.
- You’re responsible for keeping your login secure and for activity under your account.
- You must be authorised to act for the business you register.
- Tell us promptly at [email protected] if you think your account has been accessed without permission.
3Free trial, subscription & payment
- Free trial: new cafés get their first 2 months free. We collect your card details when you start, but you are not charged during the trial.
- Price: $35 per month, including GST, per café (premises). We’ll always show the price before you commit, and issue a GST tax invoice for each payment.
- Billing: after the free trial, your subscription renews automatically each month and your card is charged through our payment provider, Stripe. We don’t see or store your full card number.
- Cancelling: you can cancel anytime from your billing area. Your access continues until the end of the period you’ve paid for; we don’t give part-month refunds unless required by law.
- Price changes: we may change the price with at least 30 days’ notice by email. If you don’t agree, you can cancel before the new price applies.
4Your records and data
- Your records are yours. You keep ownership of the information you enter.
- We store your records so the service works, and so you can produce them for a verifier.
- You can export your records (PDF/CSV) at any time while your account is active.
- Because food-safety records must be kept for a period (generally 4 years), we retain your records for that period even where hidden, unless you ask us to delete them and the law allows it.

5Acceptable use
You agree not to misuse SafeServe. In particular, you won’t: break the law; upload content you have no right to; try to break, overload or gain unauthorised access to the service; or use it to store records for a business you’re not authorised to act for.
6Availability
We work hard to keep SafeServe running, but we can’t promise it will always be available or error-free. We may carry out maintenance or updates, occasionally with little notice. Keep your own copies of anything critical by exporting your records regularly.
7Our liability
To the extent the law allows, SafeServe is provided “as is”. We are not liable for indirect or consequential losses, or for the outcome of any food-safety verification, audit or enforcement action. Where we are liable, our total liability to you is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or other New Zealand law that can’t be excluded.
8Ending your account
You can stop using SafeServe and cancel at any time. We may suspend or close an account that breaches these terms or isn’t paid. If your account ends, you can export your records first; after a reasonable period we may delete data we’re not required to keep.
9Changes to these terms
We may update these terms from time to time. If we make a significant change, we’ll let you know by email or in the app. Continuing to use SafeServe after a change means you accept the updated terms.
10Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
